Some Things Never Change. Your Estate Plan Shouldn’t Be One of Them.
Humans are creatures of habit. We try something once, like it, and pretty much stick to that same routine the rest of our lives – whether it be your favorite restaurant to visit or meal to order, favorite TV show to watch, or favorite pair of jeans to wear – why change it if it works? As the old saying goes: if it’s not broke, don’t fix it.
Unfortunately, most people apply that same principle to their estate plans. They had a will or a trust drawn up a number of years ago, checked that box complete, filed that document away somewhere and likely never looked at it again.
Well, at least until they need it. When some life event happens like a sudden change in health, people often have some unanswered questions. So, they dig up those old documents collecting dust somewhere and head to see their local attorney, only to find out that their current plan no longer fits their needs.
This is where we see the intersection of Estate Planning and Elder Care Law.
Estate Planners will be able to set up your basic legal documents (like Powers of Attorney or maybe some Guardianships for younger children), but as life progresses Elder Care Law attorneys will become your new best friend.
Elder Care Law attorneys are professionals who can not only identify issues that could potentially sneak up on the aging population later in life but will be able to get out ahead of those issues before they happen while also updating any existing legal plans accordingly.
While the documents you have now might not necessarily be “broken,” they may need some updating to progress through life with you and reflect your life as it is now. Because let’s face it, those jeans you wore 20 years ago might be a little worn down. And just like those jeans, your legal documents could be wearing a lot of holes in them too. Getting your documents looked at and updated regularly is something everyone should do. If you haven’t, contact your local Elder Care Law attorney. They’ll be able to quickly spot what patches are needed to make your documents updated and whole again.
